Each year, 37,500 people in Pennsylvania will be arrested for Driving Under the Influence (DUI).  While it’s difficult to join the thousands of DUI arrests in PA, the more information you have about your arrest and the DUI process, the better.

Why Were You Pulled Over?

While you may have been ultimately arrested for a DUI, there must be a reason for your initial traffic stop. The police officer either pulled you over for erratic driving, reckless driving, a minor traffic violation or observed faulty equipment (faulty brake lights or tail lights).  The officer cannot pull individuals over for random drunk driving stops.

If, during the initial stop, the officer suspects you’ve been drinking, he or she will ask you to perform a series of field sobriety tests. These tests could be as simple as the officer asking you to walk a line or touch your nose.  The officer will also ask you to blow into a portable breathalyzer machine. The breathalyzer test is a chemical test that measures the percentage of alcohol content to oxygen and is used to estimate the percent of blood alcohol content.

Gathering Proof

If the police officer has sufficient evidence based on the field sobriety tests or portable breathalyzer results, he or she may arrest you for a DUI. The officer will take you to the police station or a hospital for additional testing. If you refuse to take the tests at the station (generally blood or urine tests to determine blood alcohol content), you will automatically lose your driver’s license for one year and your refusal can be used against you in your impending court case.

Following your arrest, you will receive a notice to appear before a Magisterial District Judge. The District Judge determines whether there is sufficient evidence to require an appearance before the county’s criminal court, or to dismiss the charges and allow you to go free. If you waive your rights to a preliminary hearing before the District Judge, your case will automatically be sent to criminal court.

Appearing in Criminal Court
