If you’ve recently been arrested for a DUI in Pennsylvania, you may be facing some stiff PA DUI penalties. Pennsylvania uses a tiered approach to determine PA DUI penalties. This tiered approach compares blood alcohol content (BAC) with previous arrests for DUI. High BAC levels combined with previous DUI arrests may result in severe penalties.

For instance, the three tiers of DUI in PA are as follows:

When previous DUI arrests or charges are added to this tier system, you can get a better understanding of the possible PA DUI penalties. For instance, a first-time DUI offense under Tier 1 General Impairment is considered an ungraded misdemeanor, carrying with it a possible probation sentence and a  fine of $300, along with mandatory attendance of highway safety school, and additional alcohol treatment or counseling.

If you’ve been charged with previous DUI offenses, your possible sentence changes considerably. For instance, if your DUI offense is a Tier 2 High BAC offense, you’ll face the following penalties:

PA DUI 1st Offense – Loss of driving license for 12 months (possibly eligible for a Occupational Limited License); jail sentence between 48 hours and 6 months; monetary fine of $500 to $5,000; possible attendance of alcohol, highway and safety school.

PA DUI 2nd Offense – Loss of license for 12 months; jail sentence between 30 days and 6 months; monetary fine between $750 and $5,000; possible attendance of alcohol, highway and safety school; when driving privileges are reinstated, ignition interlock system for a period of one year.

PA DUI 3rd Offense – Loss of license for 18 months, jail sentence of 90 days to 5 years; monetary fine of $1,500 to $10,000; attendance of alcohol, highway and safety school; when driving privileges are reinstated, ignition interlock system for one year.

PA DUI 4th Offense (or more) – Loss of license for 18 months, jail sentence of 1 to 5 years in prison; monetary fine of $1,500 to $10,000; attendance of alcohol, highway and safety school; when driving privileges are reinstated, installation of ignition interlock system for one year.
