The Real Meaning of Pennsylvania's
D.U.I Clean Up Bill


Pennsylvania has passed a “DUI Clean Up Bill” to make several provisions in it's 2004 DUI law clearer.

You see, Pennsylvania's new 2004 DUI law has caused significant confusion in the Courts. And it has caused complaints from attorneys, judges, police officers, probation officers, and drug and alcohol counselors.

In response to the complaints, Pennsylvania lawmakers enacted various amendments–known as the "Clean Up Bill"--to allegedly help clarify or correct some weaknesses and misunderstandings in the old law.

Here's several of the more important changes you should be aware of:

Accelerated Rehabilitative Disposition (ARD) probation now requires that a defendant must remain subject to Court supervision for at least six months, but not more than twelve months. Prior to the Clean Up Bill, six months was the maximum.

2) Minors, who are defined as individuals between 18 and 20 years old, who receive ARD are now subject to a ninety (90) day license suspension. Prior to the Clean Up Bill, driver's license suspensions matched that of adults and could in some instances carry no license suspension whatsoever.

3) Illegally operating a vehicle not equipped with an ignition interlock when an individual is required to only operate a vehicle so equipped, commits a misdemeanor and upon conviction shall pay a fine of between $300.00 and $1,000.00, and shall be imprisoned for not more than 90 days. Prior to the Clean Up law such a violation was only a summary traffic offense.
