Will A DUI Keep You From Getting Your CDL?

“Can I get a CDL with a DUI” is a pretty common concern these days. The answer is not as clear as we would like it to be. DUI consequences can dramatically affect your life. A DUI may hinder you from gaining employment at certain places. A conviction may come with high court fines, suspension of your license, and higher insurance premiums.

If you are convicted of a DUI, you will not be able to obtain your CDL (Commercial Driver’s License) while your regular license is suspended. After your suspension has ended, you will have the ability to get your CDL. That sounds great for the moment, but it is a little more complicated than that.

Just because you are able to get your CDL does not mean that you can get a job. A lot of insurance companies have rules that commercial companies have to follow regarding the hiring of commercial drivers. Most companies will not insure a CDL driver if they have had a DUI conviction within the last 3 years, or sometimes even longer.

This means that just because your license was only suspended for 6 months doesn’t mean that you will be getting a job anytime soon. Most people find it difficult to obtain CDL employment for close to 5 years after receiving even their first DUI conviction.

Waiting for 5 years can be too long. You are not only waiting for the opportunity to make good money, but you are also passing up promotions. The other issue is finding a job that will provide you with the means necessary to take care of your family.

You also need to be aware that the legal BAC, or blood alcohol content, may be lower than that of a common driver’s license depending on where you are at. Some states will only allow a BAC of .05 or even lower for A CDL driver. It is obviously better not to drink and drive, but if you are going to drink, you want to make sure you are clear on the law wherever you are.

Further, receiving a 2nd conviction for DUI charges could result in a lifetime CDL suspension in a lot of states. Again, the best thing to do is not drink and drive, but we all make mistakes.
